Terms & Conditions

Membership, booking and use terms for Casa Brisa.

These Terms & Conditions ("Terms") apply to memberships, Day Passes, reservations, purchases and use of Casa Brisa, our website, facilities and related services.

By purchasing, booking, registering for, accessing or using a Casa Brisa service, you agree to these Terms and any specific conditions clearly disclosed for the applicable service or booking.

Nothing in these Terms limits or excludes any mandatory rights you may have under applicable Spanish or European Union consumer law.

2. Our Services

Casa Brisa provides coworking and related services, which may include:

  • Hot Desks;
  • Premium Cubicles;
  • Private Offices;
  • Day Passes;
  • Meeting Room access;
  • Phone Booths;
  • Podcast Studio access;
  • shared lounge and coworking areas;
  • the Casa Brisa Kitchen;
  • the Member Market;
  • Wi-Fi and related amenities; and
  • other services or amenities we may introduce.

Availability varies by workspace, membership type, reservation and operating capacity.

Descriptions, photographs, layouts and illustrations of our premises or services are intended to provide a reasonable representation, but minor operational, furniture, equipment or layout changes may occur.

3. Opening Hours

Casa Brisa's standard opening hours are Monday through Friday, 9:00 AM–6:00 PM.

Hours may vary on Spanish or local public holidays, for maintenance, private events, emergencies or other operational reasons.

We will provide reasonable notice of planned closures or material changes whenever practicable.

4. Memberships

Casa Brisa offers monthly memberships associated with particular workspace types or benefits.

Memberships are personal to the registered member and may not be transferred, shared or resold unless Casa Brisa expressly agrees otherwise.

Membership gives access to the benefits associated with the selected plan but does not guarantee a particular desk, cubicle, office or other workspace unless a specific workspace or reservation is expressly included in the membership or has been confirmed.

We manage membership capacity to maintain a comfortable coworking environment and may limit or temporarily pause the sale of new memberships when appropriate.

Specific membership benefits, included credits and workspace entitlements are those displayed or otherwise communicated when the membership is purchased.

5. Membership Billing & Renewal

Monthly memberships operate on a calendar-month basis, from the first through the last day of each month.

If you join partway through a month, your first membership period may be prorated so that you pay only for the remaining portion of that calendar month.

After the initial prorated period, your membership will continue on the applicable monthly billing cycle until cancelled in accordance with these Terms.

By purchasing a recurring membership and providing an eligible payment method, you authorize Casa Brisa and its payment providers to charge the applicable recurring membership fee and any applicable taxes on the scheduled billing date until the membership is cancelled.

Applicable prices, taxes and charges will be displayed before purchase.

You are responsible for keeping your payment and billing information accurate and current.

6. Cancelling a Membership

You may cancel your monthly membership at any time.

Your cancellation takes effect at the end of the calendar month in which you cancel. Your membership and associated access remain active through the final day of that month, and the membership will not renew for the following month.

For example, if you cancel at any time during October, your membership remains active through 31 October and will not renew for November.

Except where required by applicable law, membership fees are not refunded or prorated for unused days remaining within a calendar month following a standard membership cancellation.

Cancellation of a membership does not automatically cancel separately purchased future reservations unless expressly stated or separately cancelled in accordance with the applicable booking conditions.

7. Workspace Reservations

Active members may reserve eligible workspaces up to 14 days in advance.

Day Pass customers may reserve eligible available workspaces up to 7 days in advance.

Members receive priority reservation access.

Any eligible Hot Desk, Premium Cubicle or Private Office that has not been reserved by 10:00 AM on the applicable day may be released for same-day booking.

A confirmed reservation is not forfeited simply because the customer has not arrived by 10:00 AM.

All reservations remain subject to availability and the applicable booking conditions shown at the time of reservation.

8. Day Passes

A Day Pass provides access to Casa Brisa for the date specified in the confirmed booking and during applicable opening hours.

Day Passes are personal to the person named in the reservation and may not be transferred or shared without our approval.

A Day Pass does not guarantee a particular workspace unless that workspace is specifically included in the confirmed reservation.

Day Pass customers must comply with the same applicable conduct, safety, security and access rules as members while using Casa Brisa.

9. Meeting Room

The Casa Brisa Meeting Room is available in 30-minute booking increments and is an add-on to Casa Brisa workspace access.

The person making the reservation must have either an active Casa Brisa membership or a valid Day Pass for the applicable day.

The Meeting Room is not offered as a standalone room rental unless Casa Brisa expressly agrees otherwise.

Monthly memberships may include an allotment of complimentary Meeting Room credits according to the applicable membership plan.

Complimentary credits reset according to the applicable membership plan, do not accumulate unless expressly stated otherwise and have no cash value. Unused credits do not roll over.

Once included credits have been used, additional Meeting Room time may be purchased at the applicable rate.

Bookings should include reasonable setup and departure time. Customers must leave the room reasonably clean and ready for the next reservation.

10. Podcast Studio

The Podcast Studio is available as an add-on to an active Casa Brisa membership or valid Day Pass and must be reserved in advance.

Studio availability, permitted occupancy, included equipment and applicable charges will be shown at booking or otherwise communicated by Casa Brisa.

Customers are responsible for using studio equipment appropriately and reporting any damage or malfunction promptly.

Unless Casa Brisa expressly agrees otherwise, customers remain responsible for their own recordings, files, storage, editing and backup of content created in the Podcast Studio.

11. Phone Booths

Phone Booths are generally available to members on a first-come, first-served basis.

They are intended for calls and shorter private conversations or video meetings and may not be monopolized or treated as an all-day private office when other customers are waiting.

Users should leave Phone Booths clean and available promptly after use.

12. Guests

Outside guests are permitted when attending a confirmed Meeting Room or Podcast Studio reservation, up to the stated capacity of the applicable room.

All outside guests must be registered with Casa Brisa for the relevant meeting or session where registration is required.

Registered guests do not need to purchase their own Day Pass solely to attend the applicable Meeting Room or Podcast Studio reservation.

Guest access is limited to the purpose and duration of the registered meeting or session. Guests may not independently use Casa Brisa's coworking facilities before or after the reservation without their own valid membership or Day Pass.

The person making the reservation is responsible for ensuring their guests comply with these Terms and Casa Brisa's reasonable house rules.

13. Building Access

Casa Brisa uses a secure electronic access-control system.

Members may receive mobile access credentials and a physical key fob for entry through the main door.

Day Pass customers may receive a temporary digital credential valid only for the applicable reservation period.

Access credentials are personal and may not be shared, copied, transferred or used to provide unauthorized access to another person.

Members must promptly notify Casa Brisa if a physical key fob or other access credential is lost, stolen or compromised so that it can be deactivated.

Replacement key fobs may be subject to a reasonable replacement charge.

Physical key fobs remain the property of Casa Brisa and must be returned upon request or when membership ends. Casa Brisa may charge a reasonable replacement cost for a fob that is not returned.

Access credentials may be suspended or deactivated when a membership or booking expires, is cancelled or is suspended in accordance with these Terms.

14. Booking Cancellations, Changes & No-Shows

Unless different conditions are clearly displayed at the time of booking, Day Passes, Meeting Room reservations, Podcast Studio bookings and eligible individual workspace reservations may be cancelled or rescheduled at least 24 hours before the reservation begins for a full refund.

Standard cancellations made less than 24 hours before the reservation and no-shows are non-refundable.

Meeting Room or other membership credits used for a late cancellation or no-show are considered used and will not normally be returned to the applicable allotment.

If a specific booking, event, promotion or service clearly states different cancellation conditions before purchase, those specific conditions apply to that transaction.

This commercial cancellation policy does not limit any mandatory cancellation, refund or withdrawal rights provided by applicable law.

15. Consumer Right of Withdrawal

If you are acting as a consumer and enter into an eligible contract with Casa Brisa online or otherwise at a distance, you may have a statutory right to withdraw from that contract within 14 calendar days without giving a reason, subject to the exceptions and conditions established by applicable consumer law.

For an eligible service contract, the withdrawal period generally begins on the date the contract is concluded.

If you expressly request that Casa Brisa begin providing an eligible service during the statutory withdrawal period and later exercise a valid right of withdrawal, you may be required, where permitted by law, to pay an amount proportionate to the services already provided before you informed us of your decision to withdraw.

If a service has been fully performed during the withdrawal period following your prior express request and acknowledgement, where legally required, the statutory right of withdrawal may cease in accordance with applicable law.

To exercise a statutory right of withdrawal:
Email legal@casabrisa.eu with a clear statement that you wish to withdraw from the applicable contract, together with enough information for us to identify your purchase or membership.

You may use any statutory model withdrawal form made available to you, but use of a particular form is not required where applicable law permits another clear statement of withdrawal.

16. Payments

Prices applicable to memberships, Day Passes, reservations, add-ons and other purchases will be displayed before the relevant transaction is completed.

Prices will indicate applicable taxes in accordance with legal requirements.

Payments may be processed through third-party payment providers, including Square and payment functionality integrated with our booking or management systems.

You are responsible for providing valid and accurate billing and payment information.

If a recurring or other payment fails, we may contact you to update your payment method and may suspend services or access where payment remains outstanding, subject to applicable law.

Any bank, card-provider or currency-conversion charges imposed independently by your financial institution are your responsibility unless applicable law provides otherwise.

17. Promotions, Discounts & Member Benefits

Casa Brisa may offer promotional prices, discount codes, Founding Member benefits, Member Market discounts, introductory offers or other benefits from time to time.

Promotions may be subject to eligibility criteria, availability, time limits, usage limits or other conditions disclosed with the applicable offer.

Unless expressly stated otherwise, promotions and discounts cannot be exchanged for cash, transferred or combined with other offers.

Member benefits are available only while the applicable membership remains active and may be subject to reasonable operational conditions disclosed with the membership.

Nothing in this section permits Casa Brisa to withdraw a benefit already contractually promised for a paid period in a manner inconsistent with applicable law.

18. Casa Brisa Kitchen & Member Market

Monthly members may receive complimentary self-service coffee and other clearly designated amenities in the Casa Brisa Kitchen.

Items offered for sale through the Member Market are separate from complimentary member amenities and must be paid for at the applicable price.

Customers may bring their own food and use available kitchen facilities responsibly.

Users must clean up after themselves and dispose of rubbish and food waste in the bins provided.

Customers with food allergies or dietary requirements are responsible for determining whether food or drink products are appropriate for them. Please ask us if you require available product or allergen information.

19. Mail & Business Address Use

Casa Brisa may permit certain eligible members, including qualifying Private Office members, to receive ordinary business mail at Casa Brisa where that service is expressly included in their membership or separately agreed.

Permission to receive mail at Casa Brisa does not, by itself, authorize a member or customer to use Casa Brisa as their registered office, corporate seat, tax domicile, establishment address, official legal-notice address or other legally registered business address.

Any use of Casa Brisa as an official registered, tax, corporate or legal address requires Casa Brisa's prior express written approval and may be subject to separate terms, documentation and fees.

Customers authorized to receive mail are responsible for ensuring that mail is correctly addressed and for collecting it within a reasonable period.

Casa Brisa is not a postal, courier or secure-storage provider. We will take reasonable care of mail received but cannot guarantee receipt of every item or accept responsibility beyond that required by applicable law.

We may refuse deliveries that are oversized, hazardous, unlawful, require payment on delivery, require special handling or are otherwise unsuitable for a shared workspace.

When an eligible membership ends, authorization to use Casa Brisa for mail receipt also ends unless otherwise agreed. The former member is responsible for promptly updating senders and arranging an alternative address.

20. Dogs

Casa Brisa is dog-friendly, subject to responsible use of the shared workspace.

Dogs must be well behaved and remain under the owner's control. Owners are responsible for supervising their dog, cleaning up after them and preventing unreasonable disruption to other customers.

Casa Brisa may require a dog to leave the premises if it is aggressive, repeatedly disruptive, creates a health or safety concern, causes damage or cannot be appropriately controlled.

The owner remains responsible for their dog and for any damage or injury caused by it, to the extent permitted by applicable law.

21. Shared Workspace Conduct

Casa Brisa is a shared professional environment. Customers and guests must behave respectfully toward other users, visitors, staff and neighboring businesses.

You must not:

  • harass, threaten, discriminate against or deliberately disturb another person;
  • engage in unlawful activity on the premises;
  • damage, misuse or remove Casa Brisa property without permission;
  • interfere with building access, security or safety systems;
  • share access credentials with unauthorized persons;
  • create excessive noise or persistent disruption;
  • use the premises in a way that creates an unreasonable safety risk;
  • store dangerous, unlawful or prohibited materials on the premises; or
  • use Casa Brisa for an unlawful or prohibited business activity.

Normal calls and video meetings are welcome at desks when conducted at a considerate volume. Longer, private or particularly animated calls should be moved to a Phone Booth or Meeting Room where available.

Casa Brisa may establish reasonable house rules necessary for the day-to-day operation, safety and shared enjoyment of the space, provided they are consistent with these Terms and applicable law.

22. Internet & Technology

Casa Brisa provides Wi-Fi and may provide other technology services as part of the coworking experience.

Although we aim to provide reliable connectivity, we cannot guarantee uninterrupted or error-free internet, electricity, software, access-control or other third-party technology services.

Users are responsible for maintaining appropriate security for their own devices, accounts, files and information, including appropriate backups and security measures.

You must not use Casa Brisa's network to engage in unlawful activity, interfere with the network or systems, attempt unauthorized access to devices or accounts, distribute malicious software or otherwise compromise network security.

23. Personal Property

You remain responsible for your personal belongings while using Casa Brisa.

Please do not leave valuables unattended.

To the extent permitted by applicable law, Casa Brisa is not responsible for loss, theft or damage to personal property unless caused by circumstances for which Casa Brisa is legally responsible.

Property left behind may be held for a reasonable period before being disposed of, donated or otherwise handled as appropriate.

24. Damage to Casa Brisa Property

Customers and guests must take reasonable care of Casa Brisa's furniture, equipment, technology and facilities.

You may be responsible for the reasonable cost of repairing or replacing property that you or your registered guests deliberately damage or damage through negligence, subject to applicable law.

Please report accidental damage or equipment problems to the Casa Brisa team promptly.

25. Safety & Emergencies

Customers and guests must follow posted safety information, emergency procedures and reasonable instructions from Casa Brisa staff.

Emergency exits, fire equipment and access routes must remain unobstructed.

In an emergency, users should follow applicable emergency instructions and contact emergency services where necessary.

Customers should promptly notify Casa Brisa of any condition on the premises that they reasonably believe creates an immediate safety risk.

26. Suspension or Termination of Access

Casa Brisa may take reasonable steps to protect its customers, staff, premises and operations where these Terms or applicable law are materially breached.

Depending on the circumstances, this may include a warning, temporary suspension of access or termination of membership or booking rights.

Immediate suspension or removal may be appropriate where reasonably necessary because of serious misconduct, threats, harassment, violence, unauthorized access, deliberate property damage, unlawful conduct or an immediate health or safety risk.

Access may also be suspended where required payments remain outstanding after reasonable opportunity to resolve the issue, subject to applicable law.

Any cancellation, refund or outstanding payment resulting from a suspension or termination will be handled in accordance with applicable law and the circumstances of the case.

27. Service Interruptions & Force Majeure

From time to time, access to Casa Brisa, a workspace, amenity or service may be affected by maintenance, repairs, utility failures, internet outages, building issues, safety concerns, public-authority requirements or other operational circumstances.

Casa Brisa will not be responsible for delay or failure to perform an obligation to the extent caused by circumstances outside our reasonable control, subject to any mandatory rights available under applicable law.

Such circumstances may include serious utility or telecommunications failures, fire, flood, severe weather, natural disaster, epidemic or public-health measures, industrial disputes, civil disturbance, acts or orders of public authorities, building emergencies or similar events beyond our reasonable control.

Where reasonably possible, we will communicate material planned disruptions in advance and take reasonable steps to minimize their impact.

Where Casa Brisa cannot provide a paid service as agreed, any appropriate remedy, rescheduling or refund will be determined in accordance with the circumstances and applicable law.

28. Liability

Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law.

Casa Brisa is responsible for providing its services with the level of care required by applicable law.

Subject to mandatory legal rights, Casa Brisa is not responsible for losses arising from circumstances outside its reasonable control or for losses that were not reasonably foreseeable as a result of our breach.

Customers remain responsible for their own professional and business activities, work product, contractual obligations, devices, data and personal belongings while using Casa Brisa.

Use of Casa Brisa does not create an employment, partnership, agency, joint venture or professional-advisory relationship between Casa Brisa and a member, customer or guest.

29. Intellectual Property & Casa Brisa Brand

Casa Brisa's name, logos, branding, website content, original graphics, photographs and other materials owned by Casa Brisa are protected by applicable intellectual-property laws.

Membership or use of our services does not grant you ownership of or a licence to use Casa Brisa intellectual property except as necessary for ordinary personal use of our services.

You may not use Casa Brisa's name, logo, branding or other protected materials in advertising, domain names, social-media accounts, company names or promotional materials without our prior permission.

You must not represent or imply that Casa Brisa endorses, sponsors, employs, partners with or is otherwise formally affiliated with your business unless Casa Brisa has expressly agreed to that relationship.

30. Communications & Electronic Notices

Casa Brisa may communicate with you electronically in connection with your account, membership, reservations, payments, building access, security, service changes and other matters relating to services you request or use.

These operational or transactional communications may be sent by email, through our booking or account systems, by SMS where appropriate, or through another contact method you have provided.

Marketing communications are separate. Where consent is required, promotional email or SMS communications will be sent only where the appropriate permission has been obtained.

Providing a telephone number for membership, booking, payment, security or building-access purposes does not by itself constitute consent to receive SMS marketing where separate consent is required.

Consent to receive SMS or email marketing is voluntary and is not a condition of purchasing a Casa Brisa membership, Day Pass or other service unless the communication is necessary to provide the service itself.

You may withdraw marketing consent or unsubscribe using the method provided in the applicable communication or by contacting us. Unsubscribing from marketing does not prevent Casa Brisa from sending necessary transactional or service communications.

31. Privacy & CCTV

Personal information associated with memberships, bookings, payments, communications, access credentials, guests and use of Casa Brisa is handled in accordance with our Privacy Policy.

CCTV may operate in designated areas of Casa Brisa for security and safety purposes. Appropriate signage will be displayed where surveillance is in operation.

Please review our Privacy Policy for further information about how personal data is collected, used, shared, stored and protected and how you may exercise applicable data-protection rights.

32. Changes to Memberships, Prices or These Terms

We may update our services, membership plans, prices or these Terms from time to time.

Changes to prices or material contractual conditions will not be applied retroactively to a completed one-time purchase unless permitted by law.

Any material changes affecting an existing recurring membership will be communicated with reasonable advance notice where required and will not affect mandatory rights available under applicable law.

If applicable law gives you a right to terminate because of a material change, nothing in these Terms limits that right.

The version of these Terms published on our website will show the date of its most recent update.

33. Online Contracting

Where a membership, Day Pass, reservation or other service is purchased online, the customer will be given an opportunity to review the relevant service, price and booking information before submitting the order.

The online process may require you to provide information, select a service or membership, review the applicable price and conditions, provide or authorize payment where required, and confirm the transaction.

Customers are responsible for checking information entered during the booking or purchase process and correcting errors before submitting the order. Where available, information may also be corrected through the applicable account or booking interface or by contacting Casa Brisa.

Where an online order creates an obligation to pay, this will be indicated during the checkout process in accordance with applicable law.

By completing a transaction after being presented with these Terms and any applicable specific booking conditions, you confirm your acceptance of the terms applicable to that transaction.

Confirmation of the transaction will be provided electronically through the applicable booking, payment or account system or by email.

Electronic confirmations, invoices, booking records and account information may be stored by Casa Brisa and/or the applicable service provider in accordance with our legal and operational requirements and Privacy Policy.

Customers should retain or download the confirmation and applicable Terms for their records.

Contracts may be concluded electronically. The customer-facing contracting process may be available in English, Spanish or other languages offered through the applicable platform. Where required by applicable law, legally required information will be made available in the appropriate language.

34. Complaints & Customer Support

If something isn't right, please contact us so that we have an opportunity to resolve the issue.

Consumers may also have access to official consumer complaint procedures and complaint forms (hojas de quejas y reclamaciones) as required by applicable law.

Nothing in these Terms limits any right a consumer may have to use applicable consumer complaint, enforcement or dispute-resolution procedures.

35. Governing Law

These Terms and contracts for Casa Brisa services are governed by the laws of Spain, without prejudice to any mandatory protections that apply to consumers under applicable law.

Any dispute will be subject to the courts or other competent authorities determined under applicable law.

If you are a consumer, nothing in these Terms deprives you of any mandatory protection or jurisdictional rights available to you under applicable Spanish or European Union consumer law.

36. General

If any provision of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

A failure or delay by Casa Brisa to enforce a provision on one occasion does not necessarily waive our right to enforce it later.

These Terms should be read together with our Privacy Policy and any specific conditions clearly displayed for a particular membership, booking, event, promotion or service.

Where specific conditions are clearly disclosed before a particular purchase or booking and conflict with a general provision of these Terms, the specific conditions will apply to that transaction to the extent of the conflict, subject always to mandatory law.

These Terms, together with any applicable specific conditions and confirmed purchase or booking information, form the agreement relating to the applicable Casa Brisa service.

No provision of these Terms creates rights for a third party except where applicable law expressly provides otherwise.
